Job Description

Our client is seeking a well-seasoned attorney with experience in Labour & Employment Law to join their team.

You will be responsible for:

Advisory Services:

  • Provide legal advice to clients on all aspects of labour and employment law.
  • Interpret and apply relevant labour legislation (e.g. BCEA, LRA, EEA, OHSA).

Dispute Resolution & Litigation:

  • Represent clients in dispute resolution processes, including CCMA, Bargaining Council proceedings, and Labour Court litigation.
  • Handle unfair dismissal, unfair labour practice, discrimination, and retrenchment cases.
  • Draft pleadings, affidavits, heads of argument, and other litigation documents.

Employment Contracts & Policies:

  • Draft, review, and update employment contracts, independent contractor agreements, and workplace policies.
  • Ensure legal compliance with labour-related company documents and internal HR procedures.

Disciplinary & Grievance Processes:

  • Chair and/or advise on disciplinary hearings and grievance procedures.
  • Ensure fair procedure and substantive fairness in internal employee relations processes.

Retrenchments & Restructuring:

  • Advise on large-scale retrenchments and Section 189 processes.
  • Provide support in corporate restructuring concerning employment implications.

Compliance & Training:

  • Conduct workplace audits to ensure compliance with employment laws.
  • Provide training and workshops for HR teams and management on labour law developments and best practices.

Collective Bargaining & Union Negotiations:

  • Assist clients with collective bargaining processes and negotiations with trade unions.
  • Advise on strike management and industrial action procedures.
Qualifications
  • LLB Degree
  • Admitted Attorney of the High Court
Skills

The successful candidate will have:

  • Must be proficient in English and have experience in Employment and Labour Law.
  • In-depth knowledge of labour legislation – Strong understanding of BCEA, LRA, EEA, OHSA, and case law.
  • Litigation and dispute resolution skills – Ability to represent clients in CCMA, Bargaining Councils, and the Labour Court.
  • Drafting and advisory expertise – Skilled in drafting contracts, policies, pleadings, and providing practical legal advice.
  • Strong negotiation and communication skills – Effective in union negotiations, disciplinary hearings, and client consultations.
  • Analytical and problem-solving abilities – Capable of evaluating complex employment issues and offering sound legal solutions.
Salary/Package
R25,000 – R30,000 CTC per month, negotiable commensurate with experience
